Banking Disputes

The firm works to secure favourable banking settlements for its clients, whether through negotiation or court proceedings. We also review and draft mortgage agreements with banks and handle other legal matters that may hinder a company from achieving its objectives.
A company’s relationship with its banks is central to its business. Credit facilities, letters of guarantee and documentary credits are among the financing tools on which businesses rely. Disputes over the interpretation of a facility agreement, the calculation of interest or fees, or a failure to repay can quickly threaten a business and expose its collateral to enforcement.
The firm represents individuals and companies in banking disputes before the Economic Courts. Our work includes reviewing account statements and assessing the amount claimed, negotiating rescheduling or settlement with banks, and defending clients in claims and enforcement proceedings involving collateral. We also help clients manage risk before disputes arise by reviewing credit facility and mortgage agreements before they are signed, to protect clients from unfavourable terms.
Banking disputes may also involve criminal proceedings, including cases relating to cheques or alleged offences under the Central Bank and Banking Sector Law No. 194 of 2020. The firm draws on experience in both commercial and criminal matters to address the different aspects of these disputes.
