Commercial Arbitration

Commercial arbitration has become an increasingly used method of resolving business disputes. Parties may value its procedural flexibility, the opportunity to appoint arbitrators with relevant expertise, and the confidentiality available in some proceedings. Arbitration is based on the parties’ agreement, which may be included as a clause in a contract or made in a separate agreement after a dispute arises. Egypt’s Arbitration Law No. 27 of 1994, as amended, provides the legal framework for arbitration in civil and commercial matters. Whether arbitration is suitable depends on the parties, the contract and the nature of the dispute.
Mohamed Ezzat Law Firm acts in commercial arbitration both as counsel representing a party and, where appointed, as a member of an arbitral tribunal. The firm began handling international arbitration cases in 2005, following specialised academic study of international arbitration law, its requirements and practical application. Since then, it has acted as counsel in numerous arbitrations in Egypt and abroad.
Our role can begin before a dispute arises. When drafting contracts for clients, the firm prepares arbitration clauses tailored to the transaction and the parties’ needs. Where appropriate, the clause may address the arbitral institution and rules, the governing law, the language and the seat of arbitration, helping provide a clear framework for resolving future disputes.
