Commercial Disputes

قاعة محكمة
Economic Courts

Egypt established the Economic Courts under Law No. 120 of 2008, as amended. They have jurisdiction over civil, commercial and criminal matters specifically assigned to them under a number of economic laws, including laws governing companies, capital markets, banking, intellectual property and consumer protection. The courts comprise first-instance and appellate circuits, with the applicable circuit and appeal route depending on the nature and value of the case. Their procedures include a case-preparation stage before the matter proceeds to a hearing.

The firm represents individuals and companies before the Economic Courts, from the case-preparation stage through the applicable stages of litigation and review.

Shareholder Disputes

Disputes may arise between partners or shareholders over the management of a company, the distribution of profits, dealings in shares or quotas, or the liability of managers and board members for their decisions. In some cases, the dispute may lead to a claim for the company’s dissolution and liquidation.

The firm represents partners and shareholders in these disputes and challenges general-assembly or board resolutions where there are grounds to argue that they breach the law or the company’s constitutional documents. Where possible, we also seek solutions that preserve the company’s continuity while protecting the rights of its members.

Commercial Paper

Cheques, bills of exchange and promissory notes are widely used in commercial transactions as instruments of payment and credit. Egyptian law provides specific rules and procedures for enforcing rights arising from these instruments, which may include applying for a payment order where the legal requirements are met.

The firm advises and represents clients in payment-order applications and enforcement, challenges payment orders where appropriate, and handles related civil, commercial and criminal proceedings, including cheque cases.

Bankruptcy and Restructuring

The Restructuring, Preventive Composition and Bankruptcy Law No. 11 of 2018 provides procedures intended to help eligible traders and businesses address financial distress, including through restructuring or preventive composition with creditors, as well as bankruptcy proceedings.

The firm assesses the client’s position—whether the client is a debtor seeking to preserve the business or a creditor seeking to recover amounts owed—advises on the available legal options, and represents the client before the competent court and in negotiations with creditors.

Trademarks

A trademark can be one of a company’s most valuable assets. It distinguishes the company’s goods or services and helps protect the reputation it has built with customers. The firm assists with trademark registration and protection, opposes applications for confusingly similar marks where appropriate, and brings claims relating to trademark infringement and unfair competition under the Intellectual Property Rights Protection Law No. 82 of 2002.
